Frequently Asked Questions

Timescales can vary depending on the circumstances of every transaction, but most residential transactions complete within 6-8 weeks from the date an offer is accepted. Simple transactions (e.g. no chain, mortgage in place) may complete sooner whereas more complex transactions (e.g. linked transactions or dealing with title issues) can take longer.

Missives are the series of formal letters exchanged between solicitors that make up the legally binding contract for the sale or purchase of a property. It is a misconception that missives require to be signed by clients. Missives for both a sale and purchase transactions are signed by the solicitors on clients behalf based on your instructions. Clients will, however, sign other legal documentation such as a Disposition (if selling) or Standard Security (if buying with a mortgage).

Once your offer has been accepted, the seller is not legally obliged to allow you back out to the property until the missives for your purchase have concluded. Once missives are concluded, then you do have the opportunity to ask to be given access to the property for no more than 2 occasions.

There is no fixed time for when keys can be collected and this generally depends on a number of different factors such as when loan funds are received from a lender (if you require a mortgage), settlement documentation being received by your solicitor from the sellerโ€™s solicitor and when the purchase funds are transferred and have been received by the sellerโ€™s solicitor. Your solicitor will be in touch to provide you with update on the date of entry and will let you know as soon as keys are available for you to collect.

Once missives are concluded, you are legally bound to complete your transaction. Withdrawing at this stage can result in financial penalties, including legal costs, which are determines by the other party involved in the transaction.

Yes, prior to transferring any funds, please call and confirm the firmโ€™s bank details with any member of staff within the office. Please note that our bank account details WILL NOT change during the course of a transaction, and we will NOT change our bank details via email.
